At BoomerPath, our terms are designed to protect you — not trap you. This agreement outlines your rights, our responsibilities, and the boundaries that keep this platform safe, secure, and trustworthy for everyone.
1. Acceptance of Terms
By creating an account, accessing BoomerPath, or using any of our services, you agree to these Terms of Service. If you do not agree with any part of these terms, you should not use BoomerPath. We've written these terms to be clear, fair, and enforceable — but also to reflect the values that guide everything we do.

These terms apply to everyone:
Whether you're a primary caregiver, a family member in a CareCircle, or a professional care coordinator, these terms govern your use of BoomerPath. Everyone who uses the platform is expected to follow the same rules, respect the same boundaries, and uphold the same commitment to privacy and safety. -
You must be at least 18 years old:
BoomerPath is designed for adults coordinating care for aging loved ones. You must be at least 18 years old to create an account or use the platform. We do not offer services to minors, and we do not collect information from children under 13. -
You are responsible for understanding these terms:
We've made every effort to write these terms in plain language. If anything is unclear, please contact us before using the platform. By proceeding, you confirm that you have read, understood, and agreed to be bound by these terms. -
These terms may change — but you'll always know:
If we update these terms, we'll notify you in advance and give you the opportunity to review the changes. We do not make silent edits, and we do not assume consent. If you continue to use BoomerPath after changes take effect, you agree to the updated terms.
We believe terms should be transparent, not intimidating. BoomerPath exists to support families — and that begins with treating you with respect, clarity, and honesty from the very first click.
2. Account Registration and Responsibilities
Your BoomerPath account is your gateway to organized, secure care coordination. Creating an account is fast, simple, and designed to protect your privacy. With that access comes responsibility — to keep your account secure, use the platform appropriately, and respect the trust placed in you by your loved ones and care team.

Account creation:
To use BoomerPath, you must provide accurate and complete information during registration — including your name, email address, and a secure password. You are responsible for maintaining the accuracy of this information. If your contact details change, update them promptly in your account settings. -
Account security is your responsibility:
You are responsible for safeguarding your login credentials. Do not share your password with anyone, and do not use the same password across multiple platforms. If you suspect unauthorized access to your account, change your password immediately and contact us at info@boomerpath.com. We will investigate and assist you in securing your account. -
One account per person:
Each BoomerPath account is intended for use by a single individual. You may not create multiple accounts for the same person, share login credentials with others, or allow unauthorized users to access your account. If you need to grant access to family members or caregivers, use the CareCircle feature to invite them properly. -
Accurate and lawful use:
You agree to provide truthful information and use BoomerPath only for its intended purpose: coordinating care for yourself or a loved one. You may not use the platform to impersonate others, misrepresent relationships, or store information that you do not have the legal right to manage. -
Account termination:
You may delete your account at any time through your account settings. Upon deletion, all your data — including care notes, documents, appointments, and CareCircle access — will be permanently removed. We do not retain backups or archives. If you violate these terms, we reserve the right to suspend or terminate your account, but we will notify you and provide an opportunity to appeal unless immediate action is required to protect safety or comply with the law.
Your account is built on trust. We trust you to use BoomerPath responsibly, and you trust us to protect what you share. That's the foundation of everything we do.
3. Subscription and Payment Terms
BoomerPath offers both free and premium subscription options. Our pricing is transparent, our billing is straightforward, and our payment processing is secure. We do not use hidden fees, surprise charges, or automatic renewals without notice. You control your subscription — always.

Free and premium tiers:
BoomerPath offers a free tier with core features designed for families getting started with care coordination. Premium subscriptions unlock additional capabilities — including expanded storage, advanced notifications, priority support, and access to all 29 planning calculators. Pricing and feature details are available on our Pricing page. -
Billing and payment processing:
All payments are processed securely through Stripe. We do not store your credit card information, and we do not have access to your full payment credentials. You will be charged at the start of each billing cycle (monthly or annual, depending on your plan). We send email receipts for every transaction. -
Automatic renewal and cancellation:
Premium subscriptions renew automatically at the end of each billing period unless you cancel. You may cancel at any time through your account settings. If you cancel, you will retain access to premium features until the end of your current billing cycle. We do not offer prorated refunds for partial months, but you will not be charged again after cancellation. -
Price changes:
If we change our pricing, we will notify you at least 30 days in advance. Your subscription will continue at your current rate until the end of your billing cycle, at which point the new price will take effect. You may cancel before the new price applies if you do not wish to continue. -
Refunds:
We do not offer refunds for subscription fees once charged, except in cases of billing errors or when required by law. If you believe you were charged in error, contact us immediately at info@boomerpath.com, and we will investigate and resolve the issue promptly. -
Failed payments:
If a payment fails (due to expired card, insufficient funds, or other issues), we will attempt to process it again and notify you by email. If payment cannot be processed after multiple attempts, your account may be downgraded to the free tier. You will not lose access to your data, but premium features will be disabled until payment is resolved.
We believe billing should be simple, predictable, and fair. No tricks. No fine print. Just honest pricing for a platform built to help families — not exploit them.
4. User Content and Data Ownership
Everything you create, upload, or share on BoomerPath belongs to you. Period. We do not claim ownership of your care notes, documents, journal entries, or any other content you store on the platform. Your data is yours — and it stays yours, no matter what.

You own your content:
All information you enter into BoomerPath — including care notes, medication schedules, appointment records, journal entries, documents uploaded to CareVault, and memories captured in MemoryVault — remains your property. We do not acquire any ownership rights, and we do not use your content for any purpose other than providing the services you requested. -
License to operate the platform:
By using BoomerPath, you grant us a limited, non-exclusive license to store, process, and display your content solely to deliver the platform's features. This license allows us to back up your data, synchronize it across devices, and share it with the CareCircle members you explicitly invite. We do not use this license to analyze, monetize, or repurpose your content. -
You are responsible for your content:
You warrant that you have the legal right to upload, store, and share all content you place on BoomerPath. This includes ensuring that you have consent from your loved one to manage their care information, and that you comply with applicable laws regarding medical records, legal documents, and personal data. We do not review or verify the content you upload, and we are not responsible for disputes arising from unauthorized use. -
We do not analyze or mine your data:
BoomerPath does not scan, analyze, or use your content for training machine learning models, building user profiles, or any form of commercial analysis. Your care notes, documents, and personal information are private. We treat them with the same discretion we would expect for our own families. -
Data portability and export:
You can export your data at any time. BoomerPath provides tools to download your care records, documents, and other information in standard formats. If you decide to leave the platform, you take your data with you — complete, intact, and without restriction. -
Content removal and deletion:
You may delete any content you've uploaded at any time. Once deleted, the content is permanently removed from our systems and cannot be recovered. If you delete your account, all associated content is also deleted. We do not retain copies, backups, or archives.
We do not monetize your content. We do not sell your data. We do not hold it hostage. Your information is yours — and BoomerPath exists to protect it, not exploit it.
5. Permitted and Prohibited Uses
BoomerPath is designed to help families coordinate care with dignity, privacy, and respect. We expect all users to uphold those values. The platform is built for specific, lawful purposes — and we enforce clear boundaries to protect everyone who uses it.
Permitted Uses
You may use BoomerPath to:
- Coordinate care for yourself or a loved one, including managing medications, appointments, and documents.
- Invite family members, caregivers, and healthcare professionals to collaborate through CareCircle.
- Store and organize legal documents, medical records, and emergency information.
- Track vitals, wellness, and health trends using VitalTracker and WellnessCheck.
- Create care plans, assign tasks, and set reminders to support ongoing care coordination.
- Preserve memories and life stories through MemoryVault and Journal Entries.
- Use calculators, resources, and tools to plan for legal, financial, and healthcare needs.
Prohibited Uses
You may not use BoomerPath to:

Violate laws or regulations:
You may not use the platform for any illegal purpose, including fraud, identity theft, unauthorized access to medical records, or violation of privacy laws. -
Impersonate others or misrepresent relationships:
You may not create accounts using false information, impersonate another person, or misrepresent your authority to manage someone else's care information. -
Upload malicious content:
You may not upload viruses, malware, ransomware, or any code designed to harm the platform, other users, or BoomerPath's infrastructure. -
Abuse, harass, or threaten others:
You may not use BoomerPath to send abusive messages, harass CareCircle members, or engage in behavior that creates a hostile or unsafe environment. -
Scrape, copy, or reverse-engineer the platform:
You may not use automated tools to scrape data from BoomerPath, copy our software or interfaces, or attempt to reverse-engineer our code or systems. -
Resell or redistribute access:
You may not resell BoomerPath accounts, share login credentials for commercial purposes, or grant unauthorized access to the platform. -
Interfere with platform operations:
You may not attempt to disrupt, overload, or compromise the security of BoomerPath's servers, databases, or infrastructure. -
Use the platform for surveillance or unauthorized monitoring:
You may not use BoomerPath to spy on, track, or monitor individuals without their knowledge and consent.
Violations of these terms may result in immediate account suspension or termination. In cases involving illegal activity, we may report the issue to law enforcement. We take these boundaries seriously because they protect the safety, privacy, and trust of every family using BoomerPath.
6. Intellectual Property Rights
BoomerPath is built with care, intention, and innovation. The platform's design, code, features, and branding are protected by intellectual property laws. While you own your content, we own the platform — and we protect it to ensure BoomerPath remains secure, reliable, and available for families who need it.

BoomerPath owns the platform:
All software, code, design elements, trademarks, logos, and documentation associated with BoomerPath are owned by BoomerPath or its licensors. This includes the user interface, backend systems, APIs, and all proprietary technologies that power the platform. -
You receive a license to use BoomerPath:
By creating an account, you receive a limited, non-exclusive, non-transferable license to access and use BoomerPath for its intended purpose. This license does not grant you ownership of the platform, and it may be revoked if you violate these terms. -
You may not copy, modify, or redistribute the platform:
You may not reproduce, duplicate, modify, or create derivative works based on BoomerPath's software, design, or features. You may not reverse-engineer, decompile, or disassemble any part of the platform. -
Feedback and suggestions:
If you provide feedback, suggestions, or ideas for improving BoomerPath, you grant us the right to use that feedback without compensation or attribution. We appreciate your input, and we use it to make the platform better — but we cannot guarantee that every suggestion will be implemented. -
Third-party content and integrations:
BoomerPath may include integrations with third-party services (such as Stripe for payments or SendGrid for email delivery). These services are governed by their own terms and intellectual property policies. We do not claim ownership of third-party content, and we are not responsible for their practices. -
Reporting intellectual property violations:
If you believe that content on BoomerPath infringes your intellectual property rights, please contact us at info@boomerpath.com with details of the alleged infringement. We will investigate and take appropriate action in accordance with applicable law.
We respect intellectual property — yours and ours. BoomerPath's technology is protected so that we can continue to serve families with innovation, security, and reliability. Your content remains yours, and our platform remains ours. That's the agreement.
7. Third-Party Services and Links
BoomerPath integrates with a small number of carefully vetted third-party services to deliver essential functionality — such as payment processing, email delivery, and API-powered resource searches. We also provide links to external resources for your convenience. These integrations are tightly controlled, transparently disclosed, and governed by strict data protection agreements.

When you interact with third-party services through BoomerPath, you are subject to their terms of service and privacy policies. We encourage you to review those policies before providing any information or making payments. BoomerPath is not responsible for the practices, performance, or availability of third-party services. -
We do not share your data with third parties for marketing:
BoomerPath does not sell, rent, or share your personal information with advertisers, data brokers, or analytics firms. The third-party services we use are strictly limited to operational functions — not marketing, profiling, or surveillance. -
Reporting issues with third-party services:
If you experience problems with a third-party service integrated with BoomerPath (such as failed payments or undelivered emails), please contact us at info@boomerpath.com. We will work with the service provider to resolve the issue as quickly as possible.
We choose our integrations carefully and hold them to the same privacy and security standards we uphold ourselves. Your trust is not negotiable — and we protect it at every layer of the platform.
8. Disclaimers and Limitations of Liability
BoomerPath is designed to support families — not replace professional advice. We provide tools for care coordination, organization, and communication, but we are not a substitute for licensed healthcare providers, attorneys, financial advisors, or emergency services. Use the platform wisely, and always consult professionals for medical, legal, or financial decisions.

BoomerPath is a coordination tool — not medical advice:
The platform allows you to track medications, appointments, vitals, and care tasks, but it does not provide medical advice, diagnosis, or treatment. Nothing on BoomerPath should be interpreted as a substitute for consultation with a qualified healthcare professional. Always seek the advice of your doctor or other licensed provider with any questions you may have about your health or the health of your loved one. -
No warranties:
BoomerPath is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be error-free, uninterrupted, or free from security vulnerabilities. While we work hard to maintain uptime, security, and reliability, we cannot guarantee perfect performance at all times. -
Limitation of liability:
To the fullest extent permitted by law, BoomerPath, its founders, employees, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform. This includes damages related to lost data, missed appointments, medication errors, financial loss, or emotional distress — even if we were advised of the possibility of such damages.
In no event shall BoomerPath's total liability exceed the amount you paid for your subscription in the 12 months preceding the claim. If you are using the free tier, our liability is limited to $100. -
User responsibility:
You are solely responsible for how you use BoomerPath and the decisions you make based on the information stored on the platform. We provide tools for organization and coordination, but we do not verify the accuracy, completeness, or suitability of any information you enter or retrieve. Always double-check critical details (such as medication dosages, appointment times, or legal instructions) before taking action. -
Third-party services:
BoomerPath is not responsible for the performance, availability, or practices of third-party services such as Stripe, SendGrid, or external resource links. We provide these integrations as a convenience, but we do not control them, and we are not liable for any issues arising from their use. -
No emergency services:
BoomerPath is not an emergency service. If you or your loved one is experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on BoomerPath for urgent medical assistance or crisis intervention. -
Backup your critical data:
While we implement robust security and backup systems, we strongly encourage you to maintain your own copies of critical documents, medical records, and legal forms. BoomerPath is designed to be reliable, but no digital system is infallible. Keep physical or secondary digital copies of your most important information.
We believe in transparency, not disclaimers. BoomerPath exists to support families — but it cannot replace professional guidance, emergency services, or your own judgment. Use the platform as a tool, not a substitute for care, and always prioritize safety, accuracy, and expert advice.
9. Indemnification
By using BoomerPath, you agree to defend, indemnify, and hold harmless BoomerPath, its founders, employees, contractors, and partners from any claims, damages, losses, or expenses arising from your use of the platform — including legal fees and costs.

Your responsibility for your use:
You agree to indemnify BoomerPath against claims arising from:- Your violation of these Terms of Service.
- Your violation of any law, regulation, or third-party right.
- Your misuse of the platform, including unauthorized access, impersonation, or abusive behavior.
- Content you upload, store, or share on BoomerPath that infringes intellectual property rights, violates privacy laws, or causes harm to others.
- Disputes with other users, CareCircle members, or third parties arising from your use of the platform.

BoomerPath will notify you:
If we become aware of a claim for which you may be responsible, we will notify you promptly and provide you with the opportunity to participate in the defense. We reserve the right to assume control of the defense if necessary to protect our interests. -
Reasonable cooperation:
You agree to cooperate reasonably with BoomerPath in the defense of any claim covered by this indemnification provision. This may include providing documentation, responding to inquiries, and participating in legal proceedings.
Indemnification is a standard legal protection — but we rarely need to invoke it. Most users treat BoomerPath with respect, use it lawfully, and avoid creating problems for themselves or others. If you do the same, this section will never be relevant to you.
10. Termination
You may stop using BoomerPath at any time, for any reason — and we will not stand in your way. Similarly, we reserve the right to suspend or terminate accounts that violate these terms, threaten platform security, or create harm for other users. Termination is a last resort, but it's a boundary we enforce when necessary.

Termination by you:
You may delete your account at any time through your account settings. Once deleted, all your data — including care notes, documents, appointments, journal entries, and CareCircle access — will be permanently removed. We do not retain backups, and we do not charge fees for account deletion. Your data is gone when you say it's gone. -
Termination by BoomerPath:
We reserve the right to suspend or terminate your account if:- You violate these Terms of Service.
- You engage in illegal activity, fraud, or abuse.
- You upload malicious content, compromise platform security, or interfere with other users.
- Your account remains inactive for an extended period and poses a security risk.
- We are required to terminate your account by law, court order, or regulatory authority.

Effect of termination:
Upon termination (by you or by us), your access to BoomerPath will be revoked immediately. All data associated with your account will be permanently deleted. Any outstanding subscription fees or charges remain your responsibility, and termination does not entitle you to a refund unless required by law. -
Survival of certain terms:
Even after termination, the following sections of these Terms of Service remain in effect: User Content and Data Ownership, Intellectual Property Rights, Disclaimers and Limitations of Liability, Indemnification, Dispute Resolution, and General Legal Provisions.
We don't want to terminate accounts. We want families to succeed, stay organized, and feel supported. But boundaries matter — and we enforce them when necessary to protect the safety, privacy, and trust of everyone who uses BoomerPath.
11. Dispute Resolution and Arbitration
We hope disputes never arise — but if they do, we believe in resolving them fairly, efficiently, and without unnecessary escalation. Most issues can be resolved through open communication. If not, we follow a structured process designed to protect both parties and avoid lengthy litigation.

Informal resolution first:
Before pursuing formal dispute resolution, you agree to contact us at info@boomerpath.com and attempt to resolve the issue informally. Describe the problem clearly, provide supporting documentation, and allow us at least 30 days to investigate and respond. Many disputes can be resolved through good-faith communication. -
Binding arbitration:
If informal resolution fails, you agree that any dispute, claim, or controversy arising from these Terms of Service or your use of BoomerPath shall be resolved through binding arbitration rather than in court. Arbitration is a streamlined process conducted by a neutral third party. It is faster, less expensive, and less adversarial than litigation.
The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You and BoomerPath each agree to pay your own arbitration fees, and the arbitrator's decision will be final and binding on both parties. -
Exceptions to arbitration:
Notwithstanding the arbitration requirement, either party may bring a claim in small claims court if it qualifies under applicable law. Additionally, either party may seek injunctive relief in court to prevent unauthorized use of intellectual property or to address urgent security threats. -
No class actions:
You agree to resolve disputes individually, not as part of a class action, collective action, or representative proceeding. You waive your right to participate in class arbitration or class litigation. This ensures that disputes are resolved based on individual circumstances rather than aggregated claims. -
Governing law:
These Terms of Service are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any legal proceedings (to the extent not subject to arbitration) shall be conducted in the state or federal courts located in Nevada, and you consent to jurisdiction in those courts. -
Severability:
If any provision of this dispute resolution section is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The arbitration agreement survives the termination of these Terms of Service.
We prefer conversations over courtrooms. If something goes wrong, let's talk first. If we can't resolve it together, we'll follow a fair process that respects your rights and our responsibilities. That's the commitment.
12. Changes to These Terms
BoomerPath is designed to evolve with the needs of families, the realities of technology, and the requirements of the law. If we make changes to these Terms of Service, we will communicate those changes clearly, respectfully, and in advance. We do not make silent edits, and we do not bury updates in fine print. You deserve to know exactly how the platform operates — always.

When we may update these terms:
We may revise these terms to reflect changes in law, platform features, security practices, or business operations. Every update is reviewed internally for clarity, fairness, and alignment with our core values: transparency, privacy, and respect for families. -
Advance notice:
If a change materially affects your rights, obligations, or how BoomerPath operates, we will notify you at least 30 days in advance. Notification may include in-app alerts, email messages, or banners within your dashboard. We do not make retroactive changes, and we do not assume consent. -
Your continued use constitutes acceptance:
If you continue to use BoomerPath after the updated terms take effect, you agree to the new terms. If you do not agree with the changes, you may delete your account before they take effect. We will not charge fees for account deletion, and you will retain access to your data until the moment you choose to remove it. -
Minor updates:
For minor changes (such as clarifications, formatting adjustments, or corrections that do not alter your rights), we may update these terms without advance notice. However, we will always update the "Last updated" date at the top of this page so you can see when changes were made.
We believe terms should be living documents — not legal traps. If our policies evolve, you'll be the first to know, and you'll always have the final say. That's our promise.
13. General Legal Provisions
These terms are designed to be clear, enforceable, and fair. The following provisions ensure that both you and BoomerPath are protected under the law, and that disputes are resolved in a predictable, reasonable manner.

Entire agreement:
These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and BoomerPath. They supersede all prior agreements, communications, and understandings (whether written or oral) related to your use of the platform. -
Severability:
If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. We will replace the invalid provision with a valid one that most closely reflects the original intent. -
Waiver:
Our failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future. If we choose not to act on a violation, it does not mean we have surrendered our rights under these terms. -
Assignment:
You may not transfer or assign your rights or obligations under these terms without our prior written consent. BoomerPath may assign these terms (including in connection with a merger, acquisition, or sale of assets) without your consent, provided that the assignee agrees to honor these terms. -
Force majeure:
BoomerPath is not liable for delays or failures in performance caused by events beyond our reasonable control — including natural disasters, acts of terrorism, pandemics, government actions, labor strikes, or infrastructure failures. We will make reasonable efforts to resume service as quickly as possible. -
No agency relationship:
These terms do not create a partnership, joint venture, employment, or agency relationship between you and BoomerPath. You are an independent user of the platform, and we are a service provider. Neither party has the authority to bind the other or to act on behalf of the other. -
Headings for convenience only:
The section headings in these terms are provided for convenience and readability. They do not affect the interpretation or enforceability of any provision.
Legal provisions exist to protect everyone — not to confuse or intimidate. We've structured these terms to be enforceable, fair, and grounded in common sense. If you ever have questions about what they mean, we're here to answer — clearly and without jargon.
